If you start the reclaim process before you've started your tenancy or if you are nearing the end of the tenancy and you want to continue living in your current tenancy, then it’s probably best to wait until you leave to reclaim your fees.

This is because your landlord may decide not to re-let the property to you at the end of the fixed term should you reclaim your fees.

Don't forget that you can reclaim your fees up to five years after payment!




Re: Return of pre-tenancy charges for *(required)

I am writing to request the return of the £ *(required) I was charged in relation to the leasing of the above property. The lease started on *(required). Please find enclosed a copy of the receipt for this amount.

This charge is a premium and is unlawful in terms of the Rent (Scotland) Act 1984 and the Housing (Scotland) Act 1988. The Scottish Government recently confirmed that premiums include all tenant charges in addition to rent and a deposit of no more than two months rent. This includes service and administration fees.

Please return this fee within seven days from this date. I look forward to hearing from you soon.
